These Terms and Conditions ("Terms") govern your access to the website of AK Export Industries ("AK Export", "we", "us", or "our") and the purchase or supply of investment casting, forging, sand casting, precision machining, sheet metal fabrication, and related engineering services offered for domestic and international markets.
By accessing this website, submitting an inquiry, placing a purchase order, or entering into a commercial agreement with AK Export, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of this website and do not proceed with any commercial engagement.
1. Company Information
AK Export Industries is a manufacturing and export company engaged in the production and supply of engineered metal components. Our registered manufacturing facility operates from Rajkot, Gujarat, India, and we serve OEMs, distributors, traders, and industrial buyers worldwide.
2. Scope of Products and Services
AK Export provides manufacturing services including but not limited to investment casting, forging, sand casting, CNC precision machining, sheet metal fabrication, tooling support, assembly, surface treatment, inspection, and export documentation assistance.
Technical specifications, drawings, samples, brochures, and website content are provided for general information only and do not constitute a binding offer unless expressly confirmed in a written quotation or purchase order acceptance issued by AK Export.
3. Quotations, Orders, and Acceptance
All quotations are valid only for the period stated in the quotation or, if no period is stated, for thirty (30) days from the date of issue unless withdrawn earlier.
A binding contract is formed only when AK Export issues written order acceptance or commences production after written confirmation of the customer's purchase order, whichever occurs first.
Customer-supplied drawings, specifications, 3D models, material standards, and quality requirements form an integral part of the contract. The customer is responsible for the accuracy and completeness of all technical inputs.
- Orders are subject to material availability, tooling readiness, and production capacity.
- AK Export reserves the right to decline orders that conflict with applicable laws, export controls, sanctions, or internal compliance policies.
- Any change to scope, quantity, drawing, material grade, tolerance, finish, or delivery schedule must be agreed in writing.
4. Pricing, Payment, and Taxes
Prices are quoted in the currency specified in the quotation and may be exclusive or inclusive of packaging, freight, insurance, duties, taxes, customs charges, and bank charges unless expressly stated otherwise.
Payment terms, advance requirements, letter of credit conditions, and due dates will be specified in the commercial invoice, proforma invoice, or purchase order acceptance.
- Delayed payment may result in suspension of production, shipment hold, interest charges, or cancellation of the order.
- The customer is responsible for all import duties, customs clearance, local taxes, and regulatory charges in the destination country.
- Prices may be revised if there are material cost fluctuations, exchange rate changes, or scope revisions after order confirmation.
5. Delivery, Shipping, and Risk Transfer
Delivery dates are estimates based on current production planning and are not guaranteed unless expressly agreed in writing. AK Export shall not be liable for delays caused by force majeure, customer approval delays, drawing revisions, material shortages, logistics disruptions, customs inspections, or events beyond reasonable control.
International shipments are normally made on Incoterms® agreed in writing, such as EXW, FOB, CIF, or DAP. Risk and title transfer shall occur in accordance with the agreed Incoterm unless otherwise stated in the contract.
- The customer must provide accurate consignee details, shipping instructions, and import documentation requirements.
- Partial shipments may be made unless otherwise agreed.
- Claims for shortage or transit damage must be notified in writing within the period required by the carrier, insurer, or contract, whichever is earlier.
6. Inspection, Acceptance, and Claims
AK Export maintains documented quality control procedures aligned with ISO 9001:2015 and customer-approved inspection requirements. Inspection reports, test certificates, and material certificates are supplied as agreed in the order.
The customer shall inspect goods promptly upon receipt. Any claim relating to quantity shortage, visible damage, or documented nonconformance must be submitted in writing with supporting evidence within fifteen (15) days of delivery unless a different period is agreed in writing.
- Hidden defects must be reported promptly after discovery and within any applicable contractual or statutory limitation period.
- Use, machining, alteration, or installation of disputed goods before inspection may limit or void the claim.
- AK Export's liability for accepted remedial action is limited to repair, replacement, or credit as determined by AK Export at its discretion.
7. Warranties and Product Conformance
AK Export warrants that manufactured products will conform to the agreed drawings, specifications, and material standards at the time of shipment, subject to agreed tolerances and industry-accepted manufacturing variations.
Except as expressly stated in writing, AK Export disclaims all other warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Intellectual Property
All tooling, dies, patterns, fixtures, gauges, software, technical documents, photographs, and website content developed by or belonging to AK Export remain its intellectual property unless otherwise agreed in writing.
Customer-supplied drawings and proprietary information remain the property of the customer. AK Export may use such information solely for fulfilling the customer's order and quality obligations, subject to confidentiality requirements.
9. Confidentiality
Both parties agree to keep confidential all non-public technical, commercial, pricing, and business information received in connection with inquiries, quotations, development projects, and production contracts.
Confidential information may be disclosed only to employees, affiliates, subcontractors, or advisors who have a legitimate need to know and are bound by equivalent confidentiality obligations.
10. Export Compliance and Regulatory Requirements
AK Export conducts business in compliance with applicable Indian export laws, foreign trade policy, customs regulations, and applicable international trade restrictions. The customer is responsible for ensuring that ordered products may be lawfully imported, used, and resold in the destination country.
- The customer shall not use AK Export products in prohibited end uses or for prohibited end users under applicable sanctions or export control laws.
- The customer shall provide end-use, end-user, and import documentation reasonably requested for export clearance.
- AK Export may refuse, suspend, or cancel any transaction that presents a compliance, sanctions, or diversion risk.
11. Limitation of Liability
To the fullest extent permitted by law, AK Export shall not be liable for indirect, incidental, consequential, special, punitive, or economic losses including loss of profit, production downtime, business interruption, or loss of goodwill.
AK Export's aggregate liability arising out of or relating to any order shall not exceed the invoice value of the specific goods giving rise to the claim, unless otherwise required by mandatory applicable law.
12. Force Majeure
Neither party shall be liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, fire, flood, epidemic, war, terrorism, government action, power failure, transport disruption, labour disputes, or supplier interruption.
The affected party shall notify the other party promptly and use reasonable efforts to resume performance.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
The parties shall first attempt to resolve disputes through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts at Rajkot, Gujarat, India, unless otherwise agreed in a signed contract.
14. Website Use
Users may not misuse this website by attempting unauthorized access, introducing malicious code, scraping content unlawfully, or using the website for fraudulent or unlawful purposes.
AK Export may modify, suspend, or withdraw website content or functionality at any time without prior notice.
15. Amendments and Contact
AK Export may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the website or services after publication constitutes acceptance of the updated Terms.
